Terms of service
Version 1, effective September 30, 2026
In short
InstantImpact Live designs, hosts, and runs your website, domain, and business email. You must be 18 or older. Your content stays yours, and you are responsible for what you approve and publish. We can suspend a site that breaks our rules. These terms are a first version and are being reviewed.
Who we are
InstantImpact Live is a service of Penland Investments Inc., doing business as InstantImpact, 7222 E Taylor St., Port Orchard, WA 98366 ("InstantImpact", "we", "us"). You can reach us at support@instantimpact.io. These terms are an agreement between us and you, the person or organization using InstantImpact Live ("you").
This is version 1 of our terms. We are having them reviewed, and we will tell you about any material change at least 30 days before it takes effect.
Who can use InstantImpact Live
You must be at least 18 years old and able to enter into a contract. If you sign up for a business or organization, you confirm that you are allowed to accept these terms for it. You must give us accurate information and keep it current.
We do not offer the service to political campaigns or committees, government bodies, or schools that handle student information.
What we provide
- Your site: we design your pages with you in conversation, using our AI and our building blocks, and host them on your domain with a security certificate.
- Your domain: we register and renew your domain for you as a reseller of a domain registrar, or connect a domain you already own.
- Your email: one business mailbox is included with your plan, and you can add more.
- Help from people: when our AI cannot make a change your plan covers, a person on our team makes it, free. Work beyond your plan is a paid service, quoted before any work starts.
Some features are marked "coming soon" with an expected month. Expected months are estimates, not promises.
Your free home page
You can design a home page before you pay anything. It is free, limited to one per person, and comes with limits on designs, changes, logo tries, and rewrites, which we show as you go. Nothing is registered or published until you choose a plan and pay.
Plans, payment, and renewal
- Prices are shown on our pricing page and at checkout before you pay. Sales tax is added where it applies.
- Your plan renews automatically, yearly or monthly, until you cancel. Domains and extra mailboxes renew with your account.
- Payments are processed by Stripe. We never see or store your full card number.
- Founding discount: customers who join during early access keep a fixed discount below the regular price for as long as their subscription continues. Nonprofits keep it permanently. It is limited to one per person and one per payment card.
- Price changes: our prices follow our costs. If a price changes, we email you at least 30 days before, and the new price starts at your next renewal. Founding customers keep the same discount below the new regular price.
- Refunds and cancellation work as our Refund and Cancellation Policy says.
The same-day promise
If you start by noon Pacific on a weekday (holidays excluded) with a new domain registered through us, your site goes live that same day, or your next month is free. Time spent waiting on your own page approvals does not count. Live means your site is published over a secure connection on your domain, with email working if you bought it. The free month is applied as a credit to your account.
Your content
- It is yours. You own the words, photos, logos, and other material you give us or approve ("your content"). You give us permission to store, copy, change the format of, and publish your content only as needed to run the service for you.
- You approve what is published. Our AI suggests designs and words based on what you tell us, and nothing is published until you approve it. You are responsible for your content and for making sure it is accurate, lawful, and yours to use.
- People in your photos. If you upload photos of people, you confirm that you have their permission, including for any AI images made from those photos.
- Taking it with you. You can download your words, photos, and data at any time. After three paid months, or at any time on a yearly plan, you can also get a copy of your finished site. The copy works the same as your live site, but the style names in its code are meaningless labels.
- What stays ours. The InstantImpact Live platform, including our AI instructions, our building blocks, and our design methods, belongs to InstantImpact. These terms do not give you any rights in it beyond using the service.
Domains
When we register a domain for you, you are its registrant and it is yours. Registration is also governed by the registrar's registration agreement and by the rules of the registry and ICANN, which we will show you. You can move your domain elsewhere whenever you like. Privacy protection is included where the domain's extension allows it.
Acceptable use
You agree to follow our Acceptable Use Policy. It is part of these terms.
Suspension and removal
We may suspend or remove a site, a mailbox, or an account immediately, without notice, if we believe it breaks the law or our Acceptable Use Policy, puts other people or our service at risk, or if payment fails and is not fixed. Where we can, we will tell you why and how to fix it. We may also remove content when we receive a valid legal notice, such as a copyright notice.
Your responsibilities
You are responsible for keeping your sign-in secure, for everything done under your account, and for meeting the laws that apply to your business and your site, including any notices your visitors need. The legal pages we generate for your site are a starting point based on its features, not legal advice.
If someone makes a claim
You agree to defend and compensate InstantImpact against claims, losses, and costs (including reasonable attorney fees) that arise from your content, your site, your use of the service, or your breaking these terms or the law.
Disclaimers
We work hard to keep the service running and your site online, but we provide the service "as is" and "as available". To the extent the law allows, we do not promise that it will always be uninterrupted or error free, or that it will meet every need, and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. The same-day promise is our only guarantee about timing, and its remedy is the free month described above.
Limits on our liability
To the extent the law allows, InstantImpact is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim about the service is limited to the amount you paid us in the 12 months before the claim.
Ending the agreement
You can cancel at any time, as our Refund and Cancellation Policy explains. We can end this agreement with 30 days' notice, or immediately for a serious breach. When the agreement ends, your site goes offline, and you can still download your content for 30 days. Your domain stays yours.
Disputes
These terms are governed by the laws of the State of Washington, without regard to conflict of laws rules. Before filing a claim, please contact us at support@instantimpact.io so we can try to resolve it. Any claim that is not resolved will be heard in the state or federal courts located in Kitsap County, Washington, unless the law where you live requires otherwise.
Changes to these terms
We may update these terms. We will tell you about material changes by email at least 30 days before they take effect, and record your acceptance of the new version. Each version shows its effective date, and earlier versions are kept.
